This comes as a response to CoStar’s updated terms of use
Please read below to learn what qualifies for removal

CoStar has recently updated their Media Rights and Terms, which applies to all users of their products. Out of respect for their terms and to ensure compliance with intellectual property protections, all CRMLS users must IMMEDIATELY remove ANY media from their listings that originated from Homes.com, CoStar, or any other CoStar-affiliated organization or entity. According to CoStar’s terms, this includes “photographs, imagery, videos, virtual tours, and any other media created or acquired by or on behalf of CoStar Group.” This would also include Matterport virtual tours and floor plans.

Removal of such media is required from all listings in any status, including final statuses such as Closed, Cancelled, and Expired.

If you need assistance removing CoStar-owned media from listings in a final status, please contact compliance@crmls.org.

Failure to comply with CoStar’s request to remove their intellectual property from the MLS will result in a $1,500 fine.

Summary of Relevant Terms:

Section 4 – Prohibited Uses
CRMLS operates as a broker cooperative. In Section 4 of CoStar’s terms, they state:

“CoStar Group Media may not be used or displayed on any third-party platforms, websites, or listing services that compete with CoStar Group’s products and services.”

CoStar’s terms do not define what constitutes a “competitor.” While CRMLS does not consider itself a competitor, it remains unclear how CoStar defines this term.

Out of an abundance of caution in protecting our users from possible compliance issues, and to respect CoStar’s intellectual property rights, CRMLS has determined that all media originating from CoStar, Homes.com, and any CoStar-affiliated company be removed from all listings.

If you have concerns or questions regarding these updates to CoStar’s Media Rights and Terms, we encourage you to reach out to CoStar directly for further clarification.

I would be interested to know if the change in TOS was reviewed by the boards attorneys and this policy and letter was their recommendation or just some overzealous guy at your local MLS without enough information and definitely not enough oversight.

Also, I wish zillow and co-star and matterport and the MLS would take the time and work this crap out before flooding our inboxes with these garbage knee-jerk reaction emails. Come on guys. Stop arguing in front of the kids.

@DanSmigrod I haven't received anything in my broker email box. Yet.

I personally think the MLS' mandate is a huge over reaction. I don't think they understand the terms being presented by CoStar.

A Matterport tour created by a media provider would seem to be the property of the media provider, not Matterport. Their terms are describing media that CoStar and company produces. The language in the CoStar announcement appears to me to continue to permit Matterport tours to be syndicated on the real estate search platforms.

Zillow is the one, here, who is playing games by pushing Matterport off their site and blaming Matterport's licensing terms for the API (which apparently hasn't been actually used for some time, so that can't be the real issue).

If I read this correctly CS/MP are telling MSP's they must remove any MP content from all completive services. I await you feedback but I think my interpolation of this email is correct.

There's been no pushback to my early post so again if I read this right as long if it not an fattish email then MSP in LA have lost their right to use their camera. If MP wish to carry this further then any MSP in the States has the possibility on loosing their rights to shoot property.

As I've always stated that everyone with a MP camera are merely renting the camera even though you paid for it with your hard earned cash. If you stop paying rent (subscription) the camera is worthless.

@Dataventurer you need to read the T&C's as it's always been MP stand that you do not own the final deliverable (Showcase) this is the property of MP. This has been discussed over the many years which Dan had hosted this excellent forum.

Now for the kicker since MP has decided to literary stope you from using the camera for it's intended prepose (again if I'm reading this right). Then each and everyone of you have a case to be mad that you bought the camera (with your hard earn cash) to shoot real estate and now MP has stop you from doing so. It is my firm belief there is a class action suit here for at least a petition for each and every one of you to request a full refund on your camera.

Of course you will have to return your camera to MP but that should not be an issue as it is no longer any use to you. Since you bought the camera on good faith and MP was promoting MP as the de-facto real estate capture solution You bought into this marketing ploy hook-line-and-sinker now they have gone back on their word and you no longer have a source of income.

Again this is all hypothetical if this email is not genuine, but if it is and MP or CS get back to Dan or any of you to verify the removal of your content or face a $1,500 fine I feel you have a great case to bring this class action suit for a full refund on you caners or cameras.

Don't forget those of you who have more then one MP camera this announcement renders them all useless for their intended prepose.

BTW, this will be great news for all those who are trying to sell their cameras on eBay as instead of taking a hit on the value of the camera MP would have to refund you the full price of the camera.

I await any feedback from my comments above to see if you all really want to light the fire on MP & CS.

Just more bad things happing at Matterport that shows they just don't care about us original photographers or any for that matter. I market iGuide as much as I can. I'm looking into Realsee now. Hope to give up Matterport soon.

I have a Pro 2 still in the box for $1,000 if anyone wants to buy it.

I posted this on Dan's new thread, but here for this discussion...

This is a developing story...

But the ISSUE of importance here/now is not whether a Matterport tour "may be displayed on any site" as Matterport assures us. The issue is whether it will show up on Zillow! At this point, the facts are pointing to a negative! Try and find a Matterport tour being displayed for a listing on your MLS. In my area, I couldn't find one, even after referencing the MLS to identify active listings that had Matterport links in their MLS profile. The links are there but the tour is nowhere to be found on the Zillow listing pages.

I think we are past the clarification of whether individual service providers (us!) can freely post Matterport tours (as per the release above). The next hurdle is what action to take now that Zillow, the top-ranking search site for real estate searches, is not displaying the Matterport tours that we produce and our agent/clients pay for.
