MLS rules and restrictions? Violate?20902

For those of you that are also agents or have access to agents that want to stay in the know.

I asked several agents I deal with and nobody seems to know the answer. On Realsee tours since you can embed a video, that you embed a video with the agent talking about the highlights of the home.

So when you click on the start the start point would show the screen and the video starts with video intro of agent talking about the home.

Would this violate any MLS rules?

yes. it is considered branded. you may not get caught but someone can report it and if the agent's image (their likeness too) and/or brand shows up they get fined

Typically in ALL MLS' you cannot have any signage, people or advertising in the still images. For those MLS that require their media be unbranded, the same applies to any "virtual" media. With regards to video, you can be on camera and narrate the video but without any reference as to the Brokerage or Listing Agent(s).

This excerpt is from the MLS here in Northern California.

11.6 Listing Photograph Requirements. A minimum of one photograph or graphic
image depicting the front exterior of the subject property must be attached to each listing
submitted to the MLS within one (1) day of entering the listing or the On Market Date (OMD),
whichever is later unless the Seller has directed that the property image not appear in the MLS
Compilation by signing an exclusion utilizing the MetroList-approved Waiver form. Violation of
this rule shall be subject to citations as set forth in Addendum B. All photographs must be of the
property, or the common area or common facilities benefitting the property, or be taken from the
property or from such common area or common facilities. Photographs and graphic images may
not contain company or agent logos including signs, photographs of people including agents,
commissions, bonuses, any contact information, voice, text, or graphics of any kind in the
photograph or graphic image. A link to a virtual tour must be a valid URL.

@ToddsFotos the effective date is 2018? I doubt that it is true today and metrolist is a big company and would not go against the national charter but just spending 60 seconds I found out that metrolist merged in 2020 and rules changed in 2023



I will dig more later but this is what I found on my break (yes American working at 2:43 am)

Have a similar question. I've checked my local MLS rules and it's pretty much the same. But this all seems to be in reference to the agents and brokers. I wonder if it's ok to shows tags with links to a homes appliances like this? Anyone have any experience?

@Buster6070 these are compliant. you just cant have the selling likeness, logo, broker material showing. for sale signs out front need to be blurred, things like that
