If you didn't disclose the terms of use you can't do anything. The agent acted on the sellers behalf and got media work and ownership goes to the seller of the property unless otherwise disclosed. Have it on your site, on order form and any paperwork you give.

Most MLS providers have rules about this. Here in Chicago MRED makes you check a box when you upload anything into the media tab which verifies you own the rights to use those photos, 3D tours, videos, etc. its $150 fine per instance if you use media that you do not own. If an agent is taking photos from an old listing and they weren't your client who paid for them, you should be able to report them to the MLS to have them removed.
